General terms and conditions of sale (GTC)

Article 1 - Purpose

These General Terms and Conditions of Sale govern sales made by SHAKA-CONSULT SRL via the website www.icebathyou.com.

Article 2 - Prices

The prices of our products are indicated in euros, inclusive of all taxes (VAT and other applicable taxes as of the date of the order), unless otherwise stated.

For orders placed outside the European Union, the customer is considered the importer of the products concerned. Customs duties, local taxes, or import fees may apply. These fees are the responsibility of the customer, including declarations and payments to the relevant authorities. Prices displayed in euros do not account for potential exchange rate variations for orders placed from non-eurozone countries.

All orders must be paid in euros. SHAKA-CONSULT SRL reserves the right to modify prices at any time, but products will be invoiced based on the rates in effect at the time of order validation, subject to availability. Products remain the property of SHAKA-CONSULT SRL until full payment is received.

Article 3 - Orders

Orders can be placed on our website: www.icebathyou.com.

Contractual information is presented in French and will be confirmed before your order is validated. SHAKA-CONSULT SRL reserves the right to reject an order or payment for various reasons, including supply issues or difficulties related to the received order.

Article 4 - Order Validation

Placing an order on www.icebathyou.com constitutes full and unconditional acceptance of these General Terms and Conditions of Sale without exception.

SHAKA-CONSULT SRL reserves the right to refuse an order in cases of suspected fraud, non-payment, or any other violation of these GTC.

A summary of your order details will be sent by email upon confirmation. This email will also include information about where to find the GTC on our website in a durable format.

Article 5 - Payment

By validating your order, you agree to pay the full amount. Payment is made by credit card (Visa, MasterCard, American Express, etc.) through a secure system.

We do not accept checks or cash payments.

Article 6 - Right of Withdrawal

In accordance with applicable law, you have a 14-day period from the date of receipt to exercise your right of withdrawal without justification or penalties. Products must be returned in their original condition, complete, and unused.

• Return Procedure: Contact our customer service to receive detailed instructions. Return shipping costs are your responsibility unless the product is defective or damaged upon delivery.

• Refund Policy: If the right of withdrawal is exercised, SHAKA-CONSULT SRL will refund the amounts paid within 14 days of receiving your request.

Exceptions to the Right of Withdrawal:

The right of withdrawal does not apply to:

• Customized goods.

• Goods that deteriorate quickly.

• Goods unsealed for hygiene reasons.

• Services fully executed before the end of the withdrawal period.

Article 7 - Availability

Products are offered as long as they are visible on the website and within the limits of available stock. In case of unavailability, you will be informed, and your order will be canceled.

SHAKA-CONSULT SRL reserves the right to limit the quantity of certain products in a single order.

Article 8 - Delivery

Products are delivered to the address provided at the time of the order. In case of delay, you will be notified by email.

SHAKA-CONSULT SRL cannot be held responsible for delays caused by your unavailability to receive the order.

Article 9 - Warranty

Our products are covered by the legal conformity warranty (2 years). All claims must be submitted by email within 30 days. Products must be returned complete, and shipping costs will be reimbursed upon presentation of receipts.

Article 10 - Liability

SHAKA-CONSULT SRL declines all responsibility in case of non-compliance with local legislation in the delivery country. Similarly, SHAKA-CONSULT SRL cannot be held responsible for damages resulting from improper use, incorrect installation, or failure to follow the instructions.

The buyer must adhere to the safety instructions provided in the user manual.

Unauthorized Disassembly: Any attempt to disassemble, modify, or alter the products (including chillers) by an unqualified person or anyone not authorized by SHAKA-CONSULT SRL will automatically result in:

• The immediate cancellation of any legal or contractual warranty.

• The complete discharge of SHAKA-CONSULT SRL from any liability for direct or indirect damage, whether material or bodily, resulting from such disassembly.

For any technical intervention, the buyer must contact SHAKA-CONSULT SRL or a technician authorized by the manufacturer.

Article 11 - Safety and Regulations

Customers must comply with local laws regarding the installation and safety of the product (e.g., protective barriers around the bath).

Any installation on an unstable or fragile surface is the buyer’s responsibility.

Article 12 - Force Majeure

SHAKA-CONSULT SRL cannot be held responsible for the non-performance or delay in the execution of an order due to force majeure events (natural disasters, strikes, pandemics, etc.).

Article 13 - Governing Law

These GTC are governed by Belgian law. In case of disputes, only Belgian courts shall have jurisdiction.

Article 14 - Intellectual Property

All elements related to the products sold by SHAKA-CONSULT SRL, including but not limited to designs, models, descriptions, product names, logos, trademarks, and any distinctive features, are protected under national and international intellectual property laws.

The "IceBathYou" trademark is a registered trademark owned by SHAKA-CONSULT SRL. Unauthorized reproduction, imitation, modification, or use of this trademark or its associated elements is strictly prohibited. This constitutes an infringement of intellectual property rights, punishable under civil and criminal law.

Prohibited actions include:

• Reproducing, representing, distributing, or exploiting any part of the protected products or elements without prior written authorization from SHAKA-CONSULT SRL.

• Using the "IceBathYou" trademark, logo, or any other distinctive element for commercial or advertising purposes without explicit agreement.

SHAKA-CONSULT SRL reserves the right to take any necessary action to protect its rights, including legal proceedings.

Article 15 - Personal Data

SHAKA-CONSULT SRL reserves the right to collect personal information necessary for order management. This information may be shared with partners for order fulfillment.

Article 16 - Health and Safety

The use of ice baths may have significant physiological effects, particularly on the cardiovascular system, blood circulation, and body temperature.

Precautions to take:

• Consult a healthcare professional before using an ice bath, especially if you have a medical history or specific conditions such as heart issues, circulation problems, or sensitivity to cold.

• Follow the instructions provided with the product.

• Pay attention to your body’s signals. If you feel unwell or experience any adverse effects, stop using the product immediately and consult a doctor.

Our ice baths are not intended for specific medical or therapeutic use without prior advice from a healthcare professional. The user is responsible for ensuring they are fit to safely practice cold water immersion.

 

Disclaimer of Liability:

SHAKA-CONSULT SRL declines all liability for the use of the product, including but not limited to improper use, failure to follow instructions, or any unforeseen effects resulting from its use. The user assumes full responsibility for the use of the product, regardless of the circumstances or intended purpose.

Article 17 - Changes to the GTC

SHAKA-CONSULT SRL reserves the right to modify these GTC. The new conditions will apply to orders placed after the date of modification.
